Syntensity - Terms of Service
Informal Summary
You own the content you create on Syntensity, but agree to allow others to use and modify that content on Syntensity
Without your giving explicit permission, usage of your content outside of Syntensity is prohibited (of course, as owner of your content, you can license it under whatever additional licenses you decide)
You can't use Syntensity to do anything illegal or offensive
Syntensity is not responsible for the actions of people using Syntensity
Syntensity is free for you to use; don't sue us if something goes wrong. You take any and all risks involved with using Syntensity upon yourself.
If you do something wrong on Syntensity, your account may be terminated
This license pertains to Syntensity, not to the Intensity Engine. You can use the Intensity Engine under its open source license in an entirely separate manner from Syntensity (for example, content you create with the Intensity Engine in a separate manner from Syntensity would not be relevant to these terms of service)

Terminology
"Syntensity" in casual usage can refer to both the legal entity bearing that name, and the main service it provides. In this document, "Syntensity" will refer to the legal entity, and "Service" to the service, which is the main virtual world (entitled "Syntensity") provided by the legal entity.
"Software" refers to both the provided client and server software, game scripts, etc., that are part of the Service. This includes user contributions (see below).
"Artwork" refers to meshes, textures, documentation, etc., that are part of the Service. This includes user contributions (see below).
"Content" refers to both Software and Artwork.
The "Service" consists of the aforementioned Content and virtual world (which in turn includes central server infrastructure like game servers/server instances), as well as

The client software run by users of the Service
Limitations
The Service's software is provided on an "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or implied, including, without limitation, any warranties or conditions of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A PARTICULAR PURPOSE. By utilizing the Service, you agree that you take upon yourself any risks involved.
Limitation of Liability
: In no event and under no legal theory, whether in tort (including negligence), contract, or otherwise, unless required by applicable law (such as deliberate and grossly negligent acts) or agreed to in writing, shall Syntensity be liable to you for damages, including any direct, indirect, special, incidental, or consequential damages of any character arising as a result of using the Service or any part of it (including but not limited to damages for loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses), even if Syntensity has been advised of the possibility of such damages. IN ADDITION, IN NO EVENT WILL SYNTENSITY'S CUMULATIVE LIABILITY TO YOU FOR DIRECT DAMAGES OF ANY KIND OR NATURE EXCEED FIFTY DOLLARS (U.S. $50.00).
The Service does not control all of its content, much of which is created by community members. The Service does not necessarily monitor such content, and is not responsible for it. However, if you find a particular item that is offensive, illegal, or otherwise problematic in your opinion, you may report it to the Service, which will then take reasonable steps to handle the situation.
All of your rights in this document are immediately revoked if you violate any of the terms in this license.
You agree to legally indemnify Syntensity from claims arising from your actions on, or related to, the Service.
You are not allowed to use Syntensity or any of its trademarks without explicit permission.
You are allowed to use Syntensity if and only if you can form a binding contract with Syntensity, and there are no legal restrictions upon you that would make your using the Service illegal.
License to use Content
When using the Service, you may download Content (for example, to play a particular game, the Software will download the textures, scripts, etc., or you may download Content from the main website).
You acknowledge that the original creators of Content retain full rights to that content, including copyrights.
You are granted a nonexclusive, limited, revocable license to use such Content within the Service. This includes downloading the content to your computer and using it within the Service, through the Software. You are
not
allowed to use any item of Content outside of the Service, without an explicit permission from the creator of that item of Content.
Creating Content
You can Create Content in Syntensity. "Create" refers to any content that you either (1) create within the Service (e.g., using the in-world editor, or on the Service website), or (2) upload to the service (possibly after creating it beforehand in some external tool).
Creating Content is entirely optional and on a volunteer basis. You are under no obligation to do so, and Syntensity or the Service is under no obligation to compensate you if you do.
You remain the copyright owner of all of your creations.
By Creating Content in the Service, you agree to grant a royalty-free, worldwide, perpetual, irrevocable, non-exclusive license to Syntensity, and to users of the Service, to use, copy, reproduce, process, adapt, modify, publish, transmit, display and distribute your Content in the Service.
This license does
not
permit anyone (either Syntensity or users of the Service) to use your content outside of the Service (but as you are copyright owner of your Creations, you are entirely free to grant such permission).
As an exception to the last clause, you grant permission for small numbers of screenshots and short movies to be shown of your Creations outside of the Service. For example, this allows movie clips that include your Creations to be posted on YouTube. (This is similar to the concept of "fair use" in US law.)
By Creating Content, you assert that you are acting within your legal rights, including relevant copyright laws. In particular, you may
not
upload content to the Service to which you do not own copyright.
You take upon yourself any and all legal liabilities, regarding relevant copyright laws.
Syntensity shall not be held accountable for your actions in this matter. If notified about violation of relevant laws, Syntensity will take reasonable appropriate steps.
When creating content that builds upon existing content - by modifying it, adding to it, etc. - you must retain attribution notices from the original authors. For example, the original author may have included notices such as "Copyright (c) AUTHOR NAME", in which case you should not remove those notices - but you may (and should) add your own copyright notices after you add or modify content. In other words, while you can build upon existing content, you may not claim that you created it in its entirety if you did not in fact do so; authors allow others to build upon their content in Syntensity, but they get credit for their work.
Quality of Service
The Service may have planned or unplanned downtime and other interruptions. You agree that Syntensity is not liable for any such issues.
Data (Content or anything else) on the Service may be deleted, intentionally or otherwise (e.g., due to hardware failure). You agree that Syntensity is not liable for any inconvenience such events may cause to you. In the case of intentional deletion, this may be done by the Service at any time and for any reason.
User Accounts
Usage of the Service depends upon registering an Account. You may use the Service only with an Account.
You must provide truthful information when creating your account, and can create only one account. You are responsible for making certain that by creating an account and using the Service, you are acting within the law in your legal jurisdiction.
You must take reasonable steps to keep your password secure, to prevent others from using your Account.
The Service reserves the right to suspend an account for any reason, at any time. You agree to not hold Syntensity liable for any such action.
Your account information (logs of activity, etc.) are owned by Syntensity.
Syntensity uses your account information to operate the Service, and will not give your personal information to third parties, except when necessary for legal reasons or for the protection of the Service and those using it.
Aggregate information (without any personally identifying information) may be shared with third parties in order to improve the service (e.g., analysis of overall load patterns on the servers, etc.).
Conduct
You may not harm or harass other users in any way. This includes sending malicious content (such as computer viruses), denial-of-service attacks, "stalking", "griefing", sending spam, etc. The Service retains the right to decide what behaviors are relevant to this clause.
You agree to play in a fair manner, without cheating.
You may not post offensive content. Offensive content includes any content which may have connotations of hatred or discrimination against any group, or which may be highly offensive to any group. "Group" includes any group defined by ethnicity, religion, sexual orientation, gender, etc.
Syntensity may assist in settling disputes between users of the Service, but is under no obligation to do so.
Updates to these Terms of Service
Syntensity reserves the right to change these terms of service from time to time. By continuing to use Syntensity after such changes, you agree to the new terms.
